Justice Rubinstein: U.S. should free convicted spy Pollard

High Court Justice Eliyakim Rubinstein on Thursday made a rare politically tainted comment when saying that the United States should release Jonathan Pollard, who has been jailed for almost 20 years following his conviction for spying for Israel.

"It is time the U.S. Administration free Jonathan Pollard," Rubinstein said. "20 years is more than enough time to serve in prison and I believe that the U.S. should pardon him."

Rubinstein was speaking during the opening panel of the annual conference of the International Association of Jewish Lawyers and Jurists in Eilat. During a debate on the global struggle against anti-Semitism, Rubinstein was asked if he considered Pollard?s imprisonment as an act of anti-Semitism.

In response, the justice urged the U.S. to free Pollard, saying that "he committed an error, Israel committed a grave error, but it's time for his release. I hope Israel continues appealing to the United States on the matter, but I don't think the High Court has anything to do in the matter. The bottom line is that he must be released."

Rubinstein's comment might prove to be problematic as the High Court is slated to hand rulings on two petitions by Pollard and his family over his imprisonment, including a request to recognize him as a Prisoner of Zion

Your pet scumbag was sentenced in 1987, and committed his atrocious violations of his oath, and betrayal of his country in 1984. This was during the height of the Cold War.

His betrayal was completely inexcusable.

If he had been betraying his country for anyone other than Israel, would you care about him?

"Nope. I'm not even sure that particular treaty is in the public domain, but with all the references to it by Pollard's defenders, not the least of which is Ted Olsen, and the lack of dispute by relevant accusers, I'm satisfied of its existence."

Treaties are not made in secret in this country. They are ratified by the Senate. Strike one.

BTW, in the early 80s Israel was blowing Russian pilots out of the skies over Syria. My guess, they knew about the cold war too, despite your characterization of Israel as an enemy

Oh, I disagree completely. If Pollard went 'over the fence' in response to a 'rogue' Inman, it calls into question the dependability our entire intelligence apparatus as an arm of our diplomatic efforts...What good is the word of an American diplomat if an American spook can renege on it....This government has PLENTY to lose.

That's a legitimate consideration, and I'd guess the rationale for not declassifying the 49 page memo nor the summary. Unfortunately that explanation may support the position that he was sentenced on incorrect information. IMO, the damage to our diplomatic credibility from an incident 20 years in the past doesn't outweigh the damage to our legal system IF the accusations leading to his sentencing were later proved to be false. If they were accurate, there's no damage to anyone. In time, this will all come out.

No, if I thought you were, and I've never seen your posts before, I'd have no hesitation telling you that directly. I was curious about you apparent concerns about a relatively unknown, UN level 2 NGO, founded by a couple Supreme Court Justices and a Free French (that's a WWII thing) patriot, nobel prize winner to boot, that I've never read anything controvercial about. If you just didn't know anything about them, thats fine. I can provide you with info on their website and journal I'd be happy to, but they're not all that interesting.

Got to go now, but do your realize that by the upcoming "Franklin Rule" all these people with knowlege of the sentencing documentation, not just the government employees who leaked it, but those who read and divulge it, presumably even over the internet, belong in jail?

You know that Israel has been on Russia's back for supplying the Iranians with nuclear technology.

You would think as payback, IF SUCH A THING HAD EVER HAPPENED, some Arabist and anti Semitic elements in Russia would release some evidence that Israel had helped the Soviets during the cold war.

I imagine it would make for some pretty big headlines.

No such hint from a reputable source, ever.

KGB files have been opened since the Soviets fell. No mention of Israel supplying them with intelligence from Pollard or from any other source.

Myth. Fiction. For the gullible or the hungry.

Thank you. I appreciate the clarification, and I don't doubt its validity, but Olsen refers to it as a treaty. Now whether that is his own understanding, or a statement of Pollard's understanding, I do not know.
