Chief Justice Roberts should table all cases until after Alito is sworn in. That way O'Conner will not be able to affect the outcome of any pending issues before the court during this session.

Bush should have expected this BS when he choose to campaign for Arlen Specter over a real conservative like Pat Toomey.
Just call O'Connor to the white house and ask if she'll step aside for a recess appointment. If she says yes, recess appoint Alito so he can hear the important cases until his confirmation hearings start on January 9.

Specter said he provided more time so the Democrats could not used "rushed hearings" as an excuse for a filibuster. He might not be wrong about this. I can just hear Leahy and Kennedy screaming "we do not have enough time to go through 300 Circuit Court opinions and interview 50 law clerks who worked for Judge Alito!" At least we won't have to listen to that.
Bush could have avoided this by naming Alito in the first place instead of the egregious Harriet Miers. So don't go blaming Specter for a problem the President made for himself.

I am so tired of these dolts in Congress getting nothing done on both sides of the Ilse. Rice's nomination and Gonzale's nominations were stonewalled by the likes of Levin and now our Geldings on the GOP side can't get the job done before Christmas.
