Yeah, you have a point about cover up. How can there be a cover up when there was no crime to cover up. But that doesn't apply to obstruction of justice and perjury. That's not about coverup as much as it is about breaking an actual law: You can't lie to a grand jury. You can't take an oath to tell the truth and then not tell the truth, regardless of your reasons.

Not quite correct. It is a necessary element of the crime of perjury that the testimony be material to the subject of the investigation. This of course requires that there be a subject of the investigation.

Folks, this has been my question from day 1.

No one could really give me a clear and unambigous answer.

The question was and still is this --- the OFFICIAL STATUS of Valerie Plame.

COVERT OR NOT ?

If Covert, then yes, this case should have been prosecuted. I think the fact that this case WAS PROSECUTED shows that she indeed still held the covert status.
