Judge Napolitano said what Cheney/Libby discussed has no bearing on this case. It's when Libby went to the GJ and did not reveal that fact that it became an obstruction of justice charge.Well he's just parroting the Fitz line there. If what they discussed has no bearing, then the fact that Libby didn't reveal what they discussed has no bearing either, legally.
That charge WILL get tossed out on its ear.

Napolitano now saying that obstruction of justice is the most serious of charges. It says Scooter deliberately lied to Fitz, FBI and GJ and sent them on a wild goose chase.
Conversation between Cheney/Libby is lawful. When you take it out of that context and say you got it from reporter therein lies the problem.
