Fox says Libby will be indicted today for lying to the grand jury about who told him of Plame's identity. Libby says a reporter told him, his notes indicate that Cheney told him.

Is this the Russert thing, where Russert denied telling Libby about Plame? If so, then it's Russert's word against Libby's, since the absence of a mention in Libby's notes on his conversation with Timmy don't necessarily prove anything.

What is needed here, and hopefully Fitzgerald will provide in the case of an indictment, is some exactitude.


It is possible, that Libby heard that "Wilsons wife, at CIA sent him" and that he learned her name from someone else....The phrases "Identity" and "name" are being used interchangeably in the media, and they have different meanings.

Kind of hard to prove perjury since you have to be able to prove beyond a doubt, that the person deliberately lied to mislead and obstruct the investigation. Since both Rove and Libbey have been nothing but cooperative, I'd say Fitzgerald would have a hard row to hoe in proving intent.

I mean, they had Clinton deliberately lying under oath and he was never charged with perjury, so if Fitzgerald goes ahead with any perjury charges against the White House, I think his law career is down the tubes.
