I didn't see the pdf at the end of your link. When I click on an article that requires pdf, my computer has a driver problem...whatever that means. Anyhow, were any of those people in your link, a common man type? One, who an everyday person could look up too and aspire to become a SCJ? Not a position for only blue bloods with impeccable ivy league credentials need apply type of person.

I'm sorry your computer has that problem.

I'd rather not characterize the piece, other than to describe it as a collection of historical fact; and if I ascribe some quality to any of the named nominees, my opinion becomes the issue.

A much stronger argument can be made that the Miers' supporters were anti-intellectual...

I, for one, supported Miers because I am an intellectual elitist. Although she did receive a law degree -- a negative indicator of intelligence -- her undergrad degree was in mathematics. This makes her the smartest person ever nominated to the court.

That is why Bush will not appopint her. For some reason, Marxist Harry Reid is now a Bush "advisor". Where has Bush's spirit gone? The spirit of the Constitution?

That pussy Senator Lott (RINO-Miss.) said that Bush will not appoint J.R.B. (nor Pricilla Owen) so as to "avoid a fight". This pacifist thinking is cowardly. The RATs are at war with the Constitution and the Republican Party--why does Bush sleep with the enemy?

Yes! J.R.B. and, George Bush be damned if he doesn't (or Luttig or Jones ).

I'm not going to argue this with you T. You have no respect whatsoever for me. You have put me in a little box that isn't even accurate, and so you will filter anything I say through that misperception.

There have been extremist, hate-filled attacks on both Ms Miers and on the President...........and none of them have come from the vast majority of freeper who ARE mainstream conservatives.

I'm going to repeat for the very last time that I HAVE NO PROBLEM WITH PEOPLE WHO OBJECTED TO THIS NOMINATION. What I have had problems with are the ruthless attacks on her person and her character, and on the President as well.

THAT is the most common misconception you folks have. There is no monolithic conservative "base."

The anti-Miers people didn't want a stealth candidate.

It will be interesting to see how a non-stealth candidate does. The Dems and media will go after him/her full force.

We will see if he/she can make it through with that onslaught. The media is probably licking their chops as they think of the coming ratings $.

I believe Scalia and Thomas are both Fed Society members. At the very least they support it. There is a difference between worshipping at the alter of liberal precedent, on the one hand, and having a penetrating grasp of the founders, the Constitution and the founders' Constitutional debates, on the other.

That was NOT the argument. She was criticized precisely because she wasn't well versed in "precedent".

Are you really going to argue that Meirs had the latter?

The laws belong to the people, not to the "experts" in Constitutional law.

You may have been making fun of the WH's using her Christianity as a quality.....but others were mocking her faith.

There is no way to resolve this unless both of us go back and read everything written.

Whoa! You may not have followed the thread to see what my post was about. The comment I replied to was that the withdrawl would mean O'Connor on some big decisions coming up. Unless there is a case within the next couple of months that would have overturned Roe v. Wade, the downside doesn't extend to babies. The better likelihood is that you can have a reliable anti-abortion vote in a truly well qualified Justice around when the issue comes up over the long term, who will also rule right on everything else.

I am an evengelical, and I couldn't disagree with you more. The evangelicals I know want a good conservative justice. They want a justice who will provide a strong criticism of judicial activism to the country and to his/her fellow justices. They are not looking for an "evangelical seat" on the Court.
