Can you explain how Ms Miers can create a track record in a hearing? Do you not understand the problem we have with this nomination? The speculation I have see is that she is "swell". Well what does that tell us exactly? She can say anything she wants in a heating but you know people by their actions and her actions for the last 30 years seem to be more practicing the art of being noncommittal than conservative in any significant way. The hearings will not solve the problem of never in her career really establishing herself as a bona fide Constructionist.

Souter, Breyer and Ginsburg all had this "track record" you esteem so high. Note on their track record they were approved by more then a few Republicans. I understand perfectly the problems you have with this nomination. You have been worked into a froth by people agitated someone from their clique was not selected. The speculation I have seen from you side is that she is "horrible". What does that tell us exactly? She seems to have established bona fides with the man that matters, the President.

In all this you people omit one simple fact that pretty much sinks your argument from the beginning. What makes you think your desire for a strict Constructionist is any more the President Bush's. What evidence have you? Time and time again the President has said until he is blue in the face that he will nominate judges that will follow the Constitution of the United States in making their judgment. I believe him.

I believe him far more then I believe an elitist snob who has nothing but a few books or articles to their credit.

The more I argue this matter them more I am convinced that the people who want to sink Miers prior to her hearing are exactly what I hate about liberals.
