As usual Miss Marple has it right.
I would add that it's not a good idea to get waylaid into the "stuck on stupid syndrome" either.

The "stuck on stupid syndrome" is to believe that if we could just document, prove beyond a doubt that Ms. Miers is truly a conservative everything would be o.k. This is where the stuck on stupid part comes in.

Once it is prove beyond a doubt that Ms. Miers "is" a conservative or once we dump her nomination and put a real,true blooded, "conservative" in place of her the nomination is "dead".

Think about it. How will any true conservative get through the pack of rats in the Senate let alone the rino contingent. It just won't happen.

Therefore don't get stuck on stupid.

The nomination of a true conservative won't be able to sail through the Senate-under any circumstances-after this farce has finally drawn to a close.

McCain and his Merry Gang virtually guaranteed it won't happen. Re McCain's motivation, many things might be said. He's a grandstander, he'd like to get back at Bush for real and imagined offenses. "What's good for McCain is good for . . . oh, who the hell cares who else it's good for?" Any of them sufficient motivation for him to form the Gang of 14.

As I recall, though, most if not all on FR were upset because we wanted the judicial filibuster broken before a USSC pick came up, and Rehnquist was clearly not going to last long.

Could part of McCain's calculation have been that he actually wanted to sabotage any chance of putting someone on the USSC who would vote to overturn McCain-Feingold? I don't know that McCain has ever commented on his taste in judges, but anyone with even a rudimentary brain and even passing acquaintance with the Constitution would know that McCain-Feingold would be toast with a strict constructionist court.

Clarence Thomas got his Supreme Court appointment after a brutal, ugly, vicious, nasty, down-in-the-gutter, "high-tech" lynching fight. But remember we won. We won because we fought tooth and nail. And guess what, we have a reliable conservative vote on the Supreme Court until Thomas breathes his last breath of air above ground.

I think Janice Rogers Brown could get appointed under such a scenario and achieve an overwhelming 51-49 approval vote in the Senate. She would be so steeled by this process she would vote conservative until she was 110 years old.
