Rove Said to Testify in CIA Leak Case
AP ^ | October 6, 2005 | JOHN SOLOMON

Posted on 10/06/2005 12:19:41 PM PDT by West Coast Conservative

Federal prosecutors have accepted an offer from presidential adviser Karl Rove to give 11th-hour testimony in the case of a CIA officer's leaked identity but have warned they cannot guarantee he won't be indicted, according to people directly familiar with the investigation.

The persons, who spoke only on condition of anonymity because of grand jury secrecy, said Special Prosecutor Patrick Fitzgerald has not made any decision yet on whether to file criminal charges against the longtime confidant of President Bush or others.

The U.S. attorney's manual requires prosecutors not to bring witnesses before a grand jury if there is a possibility of future criminal charges unless they are notified in advance that their grand jury testimony can be used against them in a later indictment.

Rove has already made at least three grand jury appearances and his return at this late stage in the investigation is unusual.

The prosecutor did not give Rove similar warnings before his earlier grand jury appearances.

One little detail that I noticed rereading the NRO story: Cooper claimed in the email that Rove spoke on "double super secret" security, but later joked that this was something he made up, something he'd heard in a James Bond movie, or something like that. It's interesting that he would insert a false security claim into the email, then have to backtrack later on, saying it was a joke. That casts doubt on his credibility.

Hope you're right. However, Judge Napolitano was just on Fox. He believes that Rove is in trouble and that Rove is trying to convince the jury not to indict him. He also said that it is not set in stone that the the prosecutor has to notify Rove if he is a target.

I hope you're right but I always suspected that Fitzgerald wanted to bag a Bush admin figure.

I've been at work all day, what's with the 22 number that was floating on leftie websites. That would be almost all the Bush admin.

Tell me that's wrong.

The "22 indictments" figure is a Dem fantasy, not reality.

That number might well include reporters. We can't assume that it's all people in the Bush administration.

Ask Susan McDougal if you are allowed to take the fifth before a Grand Jury.

"Except Rove offered to provide further testimony back in July and Fitzgerald wanted Miller on the record first. Obviously it is not the Rove camp behind this highly spun leak."

Bingo. As to the leak, it ain't Rove's camp and it ain't Fitz. Spin...

Seems like I remember Larry Johnson being discredited by many astute FReepers several months ago.

That is my recollection as well.

Call me crazy, but if I were ms. Miller, and she is supposed to be a democrat, and she had a chance to turn in the president's right hand man, and didn't do it. Thats just crazy. I still think that the link came down, from a top DEMOCRAT. Thats just my opinion.

Yes, there was a post on FR this morning before I went to work quoting a leftie website saying 22 indictments. I couldn't come up with 22 unless I included the twin.

This is a mess. Bush should never have agreed to getting a SP for this silly case.

The media will use it to impeach Bush, mark my word.

I think George W. Bush would be wise to cut Karl Rove loose.

For what? I think you would be wise to STFU until we know what is going on.

A perjury indictment (at the least) for Rove has been the buzz on K Street for days now.

If Karl falls...the hope is he'll let go of the President's coattails first. (But, "they" don't seem to be counting on it)

True, but she was never on the federal payroll. Starr wanted her testimony about her business relationship with the Clintons.

Every American has an absolute right to assert their 5th Amendment rights, but there is no right to a federal job (unless you're a civil servant and your supervisor tries to fire you for slacking off, but that's another story).

If anyone can come up with a counterexample I'd love to hear it, but I've never heard of a government employee-- from police officer to White House aide-- pleading the 5th and keeping their job.
