The 1993 indictment of Kay Bailey Hutchison was not thrown out. The prosecutors declined to press the case to trial when they received unfavorable rulings in the preliminary hearings. In other words, they knew they wouldn't win.

So, the declining part would occur now, after the grand jury indictment?
