Yeah but if he had really tried to save her, she might well have lived. His failure to do so compounds his crime and murder is not a crime with a statute of limitation. This is true. And I bet there isn't a day when the thought of the possibilty he could have saved her, or that she could have lived for a while in an air pocket while he ran and hid...must torment him.

But NOBODY has suggested he purposely drove that car into a canal with the intention of killing her, NOR did he KNOW that she could be saved and simply did whatever he had to, in order to make sure she died.
And he might have been totally smashed and unable to make sound decisions for all we know.
