Well to be fair if I saw a picture like that, I'd wonder myself.
Granted, I haven't seen the photo, so I really shouldn't be drawing any conclusions. I suppose it could really depend on the perspective from which the picture was taken. Assuming it was an innocuous act, an inexpensive digital camera would've saved them a lot of hassle.

And if you did see the photo you'd have to be turned in for possessing child porn. Since seeing it is potentially a crime, the public can't look at it to make a democratic decision if it is or if it isn't and you are left with the characterizations made in press conferences. The rule of where the line in drawn is done only behind closed doors. It is a catch-22 for democracy.
