Is not it the case that Miller is in jail not because she will not give up a source, but because she refuses to testify. If she says XYZ told her Valerie Plame is her source there was no foul or commission of a crime because the Espionage Act of 1982 was not breeched. She could say anything she wants about Plame and it may or may not be true, but it would not violate the act. So what is the principle upon which Miller stands that requires her to go to jail?
Do we conclude that journalists are above the law? Is that the principle?
