A prohibition was a perfect example (BTW, Most Smoking bans it seems, are being passed by Republicans).

I've never heard such a proposal. There should be no censorship of Satellite or Cable, but I don't think anybody's disagreeing with you there.

Here's one recent example!

Now, for the record, I had mixed emotions on this issue. While it was adjudicated properly it was not necessarily a just ruling and subsequent "good" court order. However, check out those poll results once again and then explain to me that this does not qualify as a legitimate answer to the question you posed.

George Will, in an editorial he wrote today (June 24, titled "No limits"), writes of the SCOTUS imminate domain ruling. This is how he closes his piece:

Conservatives should be reminded to be careful what they wish for. Their often-reflexive rhetoric praises "judicial restraint" and deference to — it sometimes seems — almost unleashable powers of the elected branches of governments. However, in the debate about the proper role of the judiciary in American democracy, conservatives who dogmatically preach a populist creed of deference to majoritarianism will thereby abandon, or at least radically restrict, the judiciary's indispensable role in limiting government.

George and Cal are pretty conservative guys so perhaps being you're being too dismissive of the the issues that Cal brought up.
