Graham and DeWine both just appeared on C-Span2, and they both said that if the democrats violate the deal and filibuster people that they shouldn't, both Graham and DeWine will vote for the nuclear option.
Graham also points out that not every nominee gets confirmed in ANY senate.
And he says that the three now up (Owen, Pryor, Brown) will get STRONG bi-partisan support.
He also said that being conservative is NO LONGER an extraordinary reason.
So at least for Graham and DeWine, if the democrats filibuster because the judges are conservative they will declare the deal broken and vote for the nuclear option.
I don't think we can pass final judgment on this until after we see the final votes on the next 9 justices. I believe that 8 will get votes, and one (Saad) will either get a vote and fail, or will be withdrawn.
We will get strong votes for Brown, Pryor, Owens. We will also get the three michigan justices, and one other. Myers I think is the test case for democrats. From what I heard Graham say, while Myers is not "part of" the guarantee", he will get a vote. So I think the idea is that if they declare Myers is "extraordinary", the republicans will bail on the deal.
Anyway, that's my take.

Which IMHO, means that Kennedy, Schumer, etc. could call for it and it wouldn't mean that they went back on their deal....What a crock!!!
