This came up before when he ran in 2002. I don't know that there was ever resolution to the question. Some of the arguments had to do with whether we owned the Panama Canal region at the time, and whether or not he born there because his parent was in the military stationed there.

WASHINGTON - Breaking years of gridlock, the Senate cleared the way for confirmation of Priscilla Owen to the U.S. appeals court Tuesday amid fresh debate over an ambiguous compromise on President Bush's current and future judicial nominees. "I appreciate the fact I'm finally going to get a vote," said Owen, swiftly invited to the White House for a presidential show of support. "She is my friend and more importantly she is a great judge," said Bush, a fellow Texan.

Are ya'll watching Brit's show---

Krauthammer says he thinks the deal is ONLY for those 3 judges and the rest have been thrown out---by the rep weasels...

Easton thinks that the dems won, but also thinks the agreement will not last...

Hey, now, I've worked in San Francisco for 40 years and can honestly say I have never seen a sheep brought to work....some of the people I've seen at work LOOK like sheep, but none had 4 legs!!

July 22nd, three more judicial nominees were brought up for a vote before the U.S. Senate. Cloture votes on all three nominees for the U.S. Court of Appeals for the Sixth Circuit in Michigan -Richard A. Griffin, David W. McKeague, and Henry W. Saad-failed amid concerns over past decisions which hindered civil rights and worker's rights.

The vote to invoke cloture to end the filibuster of William G. Myers, III as a federal judge for the U.S. Court of Appeals for the Ninth Circuit failed 53-44.

Over 180 civil, human, disability, senior citizens', women's, Native American, planning and environmental rights organizations opposed confirming Myers based on his record as an advocate for industry over the public interest. These groups, of which SIECUS was one, also cited Myers' lack of experience and his open criticism of privacy laws as reasons for opposition. The letter expressed concern that a judge who has shown little regard in the past for individuals' right to make private and independent decisions about their own sexual health and wellbeing is apt to continue that pattern during a lifetime appointment to the federal bench.

I think that was the argument. There's some sort of provision for children of servicemen born outside the U.S. due to the parent being stationed there.

He lost the primary, so the question was never really resolved. Maybe I'll ask the citizenship folks down the street what the rule is next time I see them.
