I read the no rules change as being expressly contingent upon the Dem 6 following through on their no-filibuster for future nominees pledge. Clearly, ideology alone is not an extraordinary circumstance, since they agreed to confirm the 3 most conservative nominees.
That's how Lindsey Graham is reading it as well.. If Lindsey reads it that way, you can rest assured that so does DeWine...

Two quick points responding to the moderates deal on judicial filibuster: 1. The national center-right coalition opposing judicial filibusters, and the Senate leadership, will continue to push for an up or down vote on every qualified judicial nominee.
2. The fact that Senate Democrats are willing to allow cloture on Owen, Brown, and Pryor indicates that conservative judicial philosophy cannot be considered the basis for a filibuster, or an extraordinary circumstance.
Sounds about right to me.

The analysis you linked to is weak. The nuclear option is OFF the table for the 109th Congress. The republican deal makers have sworn not to vote for it, period. The democrats have only agreed not to fillibuster unless the circumstances are extrodinary. Guess who gets to decide extraordinary? You nailed it (as much as I wish it weren't so)!

It gets 3 judges confirmed. Other than that, the Dems agreed to essentially nothing, not even to vote for cloture in non extraordinay circumstances (which "extraordinary" defined by them), just that they don't think the filibuster is appropriate in such circumstances. The nuke option is off the table until 2007, in the final two years of Bush's term, when the Dems might have more votes than they do now.

There's only one good thing here: Frist is dead as a presidential candidate unless he successfully pulls the nuclear trigger at some point in the future. Today's sellout by the RINOs makes that very unlikely.
The 2008 field has begun to take shape. And Bush is starting to look like a lame duck.
