What's happens if the dems ALLOW Owen, Brown & others to have an up/down and wait to not invoke cloture until a SC judge?

What's happens if the dems ALLOW Owen, Brown & others to have an up/down and wait to not invoke cloture until a SC judge? The Republicans would hold off on the Constitutional Option until the RATs filibuster a SC nominee - and then pull the trigger.
