The real question is, why couldn't Jack Bauer be Majority Leader?
Jack Bauer as Majority Leader? I don't know if I could handle the kind of body count he generates in a crisis.
Fictionally speaking, Bauer would take custody of the entire minority for national security reasons. Following preliminary information gathering, it would take decades to sort out the charges. :-)
