Cheney will make the ruling if there is a 'point of order' submitted. He'll only vote if there is a 50-50 tie on the democrat appeal of his ruling. That all assumes a point of order being submitted.

Also should the Dems fail in their effort to filibuster all "extreme" judges will they act like the Texas Dems and visit New Mexico and Oklahoma for a few months?
