That's why I'm a staunch advocate of abolishing judicial review. It all comes down really, to one question: who is the master of the American house: the people or the judges?

Awww, you must not have been paying attention, this is a no brainer.

I disagree. I think judicial review is a fine principle, but we must remember that impeachment is as well. This judge clearly overstepped - by leaps and bounds - his judicial authority, and ought to be impeached for it.

"That's why I'm a staunch advocate of abolishing judicial review..."

You cannot possibly mean that literally. Judicial Review cannot possibly be abolished altogether as this is what happens when one party sues to block the enforcement of some law that they feel should be challenged on validity.

Abolish Judicial Review and no-one, anywhere in the US will have any legal recourse for challenging any law that happens to get passed. I'm sure you meant this figuritively right? What can be done is to put some rules into place regarding the interpretation of the constitution and the various laws of the states and the feds.

There is nothing stopping congress from passing a bill which defines "Judicial Review" and if that is overturned, a contitutional amendment on this issue may well be in order.

I believe Justice Scalia may well be the best bet at authoring such an amendment.
