Republican judges killed Terri

There's a good reason congressional Republicans will not hold investigative hearings on the judicial homicide of Terri Schiavo.

Republican judges killed her, just as surely as the Democrat judges did.

This is the dirty little secret that would be uncovered if Republican lawmakers scratched beneath the surface of how and why the 11th Circuit ignored the will of the people and the U.S. Congress and the president of the United States in refusing a full review of her case as decided by Republican county Judge George Greer.

While much attention has been placed on the fact that U.S. District Judge James Whittemore, a Bill Clinton appointee, twice violated the will of Congress in refusing the review, less attention has been focused on the fact that every single Republican appointee on the 11th Circuit supported his decision.

The only dissenter was Charles R. Wilson, a Bill Clinton appointee.

All six judges nominated by President Ronald Reagan, President George H.W. Bush and President George W. Bush, including William Pryor – who was recess-appointed just last year to avoid a Democratic filibuster – voted not to save Terri's life.

All six!

This fact was brought to my attention by Denver radio talk-show host Bob Enyart, who is urging those who care about life in this country to reconsider their strategy of electing Republican politicians to appoint them.

It's an idea worth considering.

But it is also critical to understand there will be no accountability for judges of either party who ignore the law.

Let's recall why President Bush was in such a hurry to appoint Pryor in the first place.

He had done the president's dirty work in removing Judge Roy Moore from his lawful seat as chief justice of the Alabama Supreme Court over the Ten Commandments monument.

It was Pryor who upheld U.S. District Judge Myron Thompson's order to remove the monument or remove Moore from his elected office. In what can only be viewed as a reward – a quid pro quo – Pryor, unlike many other far more qualified Bush nominees to the federal bench, was promoted to the 11th Circuit.

There, he joined five other Republican colleagues who denied Terri Schiavo her right to life, liberty and the pursuit of happiness.

I don't know what the answer is, but it is clear the solution to getting better judges is not simply voting Republican.

In fact, as the Terri Schiavo case demonstrates, the fact that all six Republican-appointed judges on the 11th Circuit flouted the law and the will of the people in this case and the fact that the Republicans in the U.S. Congress fear to hold them accountable, it is perhaps less likely that we will solve this problem by just voting Republican.

I'm certainly not suggesting Democrats will solve it. Surely, they will only make it worse. What I am suggesting is that we have a completely unaccountable judiciary in this country. The judges have become the lawmakers. It really doesn't seem to make much difference who appoints them.

Let's suppose Democrats appoint bad judges 99 percent of the time. And let's suppose Republicans appoint bad judges 75 percent of the time. Can we really clean up the judiciary by electing people who are going to appoint bad judges most of the time?

I don't think so.

I don't pretend to have the answers.

But I think I have a firm grasp of the problem.

When was the last time anyone fixed a problem without recognizing its true nature?

As usual, the people are going to have to lead. Don't leave it to the politicians to fix the mess. They won't do it.

Ordered state troopers to take her by force as the local police resisted? He would have put his brother in the position of having to use force against him.

You are correct.

There is not a judge on any federal court who can not be called in front of the senate and removed from the bench by a simple majority vote of the Senate.

The politicians won't do their job and remove these judges for their crazy decisions because they want the judges to make these hot button social decisions so they don't have to take a stand and lose some votes.

they can then just point their fingers at the judges and blame them when the heat is turned up.

It doesn't bother the judges because they don't answer to the public and they get the power to make law to suit their whims. It's a win win for the politic ans and the judges and a lose lose for the American people.

If they would just impeach about a half a dozen of these liberal wackos you would see a remarkable bit of sanity return to the federal bench.

The Democrats are worthless as well. Third party here I come. Dean is a scumbag and so were those scum Dems who were speaking against Terri being able to get help from being murdered when the Congress convened.

Thanks for an informative article. The only judge on the 11th Circuit who got it from the beginning - the first time around - was the Clinton appointee.

I've also heard that Gibbs, the Schindler's attorney didn't do a good job with his filing. That maybe the case. I'm not sure. However, it seems that the Clinton appointee undersood what congress requested inspite of Gibbs, the first time around.

*In his dissent, Judge Charles Wilson, a Clinton appointee, said "Congress intended for this case to be reviewed with a fresh set of eyes. Today, we are not called upon to second-guess the wisdom of Congress, but to apply the law it passed."*

Judge Charles Wilson is a judge who appears to be fair minded and isn't on a power trip. He understands the legislative powers of congress and the concept of Due Process, imo. Greer reduced Terri to no more than the property of a monster husband, who could dispose of her like an old shoe. No wonder a probate judge ruled on Terri's life or death.

It takes 2/3rds to remove. That makes sense too, thinking in the context of appointments. A judge can be appointed by a simple majority advise & consent. But if Congress sees that its will is being subverted by a judge, a supermajority can remedy a past error of Congressional judgement.

Clause 6: The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two thirds of the Members present. (Article I, Section 3)

It does not discuss the hurdles involved in reversing a trial court's finding. It does not probe the question of whether or not civil procedure is equipped to handle "tough cases" (e.g., should there be additional procedural safeguards? If so, when?

The exact location of Terri's ashes is "not buried."

Her remains can stay in that exact location forever, and "not buried" plus "no plan to inter them" plus "no plan for a memorial service" is in full conformity with Greer's order.

If Greer wanted Terri's remains to be buried, he could have ordered that. I don't believe Greer ordered or would order burial. I believe he ordered Schiavo to disclose burial and memorial service plans. If Schiavo has no burial or memorial service plans, he has nothing to disclose.

The distinction is NOT Republican/Democrap, but Conservative/Liberal. The same is true for both houses of the Congress!

In your vast experience, neither of you have been to funeral where a urn or other such receptacle was placed in a sealed vault on cemetery grounds, much as a coffin may be vaulted or 'buried'?

The actual 'burial' location offered to MS by his aunt and uncle isn't known for the reason it would become a shrine for the pro-life movement who witnessed Terri's murder as the most insidious and barbaric judicial decree in the history of our country.

Heck. I'm only half-vast, and I've been to a few services where the ashes were interred.

Impeachment takes place in the House of Representatives and is by simple majority.

It is the trial that takes place in the Senate and a two thirds of those present to convict.

Some if impeached by the House resign to avoid trial in the Senate.

Dean is definately a scumbag and worse. He's very pro killing of Terri. There's alot of demos who were against what happened to Terri. Dean might very well be in for a big surprise if he keeps using the fact that some Republicans tried to save Terri.

Dean is a fool if doesn't realize there are conservative democrats who think killing an innocent disabled person, is nothing but evil and an outrage. What happened to Terri isn't a partisan thing. It crosses party lines. I know a demo who wants to change parties and become a Republican over her party's attitude about Terri.
