You know that reminds me of the statement Jim Robinson made some time back about we need to have a common cause to get Bush elected and get conservative judges- that our overwhelming concern should be activist judges. He caught alot of flak for that as I recall. He's absolutely right though.

He was quite prescient, no doubt there. And now we see even more so how important it is to get rid of, by attrition, activist judges.
