I'm shocked by some of the comments I've seen regarding this issue. I'm a libertarian and I cannot understand how anyone cannot see that this is a blatant violation of this woman's most basic right. Her right to life.

In cases brought before the Florida judiciary concerning Living Wills the courts have always sided with the Will.

And I am saying that the precedent this case has set calls into question whether or not the paradigm established up to now will continue. Citing past history is fine as far as it goes, but need I remind you and others that there was a time in this country's past were the courts stood as guardians of inalienable rights. They have now become the dispensers of them, granting the right to live or die to innocent persons as the courts decide, with no regard to what has been up to now an inalienable right.

Like I said, give me enough hearsay evidence from witnesses that may or may not have a conflict of interest, the ear of a sympathetic (perhaps conflicted) judge, and I will shred any document you might have claimed held sway, especially if you are unable to give voice to your present desires.

Anyone listening to Rush right now? He's reading the opinion of Judge Birch (sp?), the judge who effectively put the last nail in Terri's coffin. It's frightening. He apparently believes himself above the president and Congress. Rather than taking time to review the facts of Terri's case, he took 15 hours to write an opinion that, in part, chastises the executive and legislative branches for interfering, as well as the public for daring to question the judiciary.

I know where my battle's going to be for the next few years.

I meant when it clearly goes against a law of nature - such as human freedom and liberty in the case of slaves in the 1800s. The "law of the land" clearly denied them this unalienable right.

Yup, injustice existed and still exists. We need to fix it, and we need to fix it right. Otherwise someone will just "fix" us because the Sheriff always has the biggest gun.

Interestingly, along with the usual martyr complexes and sarcasm, several have pondered leaving FR. However, I highly doubt any of them would actually leave.

Yes, legislation from the bench, again. The 11ths refutation of the argument that Terri's rights being violated did not cite a single law that was passed by a legislature. It cites the 'law of the case', decisions by other judges. Nowhere in the Constitution have I found the authorization for the Judicial Branch to enforce 'case law'. Nowhere have I seen the authorization for the Judicial Branch to even make law, be it 'case' or otherwise.

So we are no longer under the Constitution. We are under rule of a Man, known as Judge. Our very lives are at peril.

Our Founders would have spoken but two words... "To Arms!"

Sometimes blunt language is appropriate to asinine statements. She did not die 15 years ago. That was a bald faced lie. She could breathe. She had a heartbeat. She had brain activity. She was alive.

Now you can dedicate your out of control emotions to getting Hillary Clinton elected as the next president and giving Congress back to the Rat party.

What the hell does Hillary have to do with this? Absolutely nothing.

I guess you're saying we should just surrender to the judges and make NO attempt to protect ourselves? Wrong. I am disgusted with the fact that hearsay was the deciding factor in this case. (My tinfoil hat is squarely fitted to my head, and I believe "Judge" greer took a payoff years ago from Shiavo, which is why he couldn't give a different ruling. Blackmail.) However, I intend to make my wishes known officially. There will be no hearsay if my life is in the balance.

I am not saying that at all. I am saying that this case has set a dangerous precedent. By allowing hearsay evidence to be decisive in a matter of life or death for an innocent person, the court has placed in grave peril the prior wishes of any person who may have expressed them. A skillful barrister can always find a way to pile up enough hearsay evidence to tip the "clear and convincing" standard against you.

What is the solution? The original vision of the founders, wherein the three branches of government were coequal. Such is not the case now, not by a long shot.

and those who are supporting them. (what's with some posters here? were they not needed on other ongoing issues like gun rights and landgrabs, that they had the time and need to so actively disparage those who were trying to help in this grievous injustice against Terri and her parents?)

There is an ACTIVE effort to redefine Terri's situation and death, and that's where I see the next battle, for those who have eyes and hearts to be concerned.
