There are 12 en banc. Last time the vote was 10-2 against the Schindlers (therefore pro-Michael). That's when they met en banc. Prior to that the appeal was first made to a 3-judge panel, and they voted 2-1 against the Schindler's appeal, which is when it then went to the full en banc court and ended up as I stated above. The 2-1 vote was 1 Pub (appointed by Bush SR) plus 1 Dem (appointed by Clinton) for, and 1 Dem (appointed by Clinton) against the appeal.

An earlier post on the first page of this thread I think...said the 11th decided tonight -en banc -all 12 to grant the petition of the parents to a new hearing ...or the hearing of a new hearing? kinda confusing.I am not a lawyer..but I have stayed at a Holiday Inn Express before:)

Okay so this is not good. 10 to 2 ...hmm that is a lot of persuading that needs to be done.
However, they could have just denied the request tonight and have the entire think over with.
Seems to me someone on that court is interested in hearing this new petition, correct?

I heard that the 10-2 was misleading. All that means is 2 published their dissent. It could have been 7-5, actually..

HUgh Hewitt said that there were 2 written dissents,which did not mean necessarily it was 10-2,but could have been any other result.7-5 , or any combination thereof.
