They feel that there was a clear error in the district court's ruling and that is why they are appealing. I think due to the fact that the old record was looked at and was not considered de novo.

Donna Fiducia reporting that, now that the US Federal District Court in Atlanta had more time to consider the case, they decided the 11th Judicial Circuit (thank you, JUDGE WHITTEMORE) ERRED in NOT considering the facts of the case instead of the rulings of the state court!!!!!!!!!!!!!!!
