Maybe, but intervening in the commission of a crime is a totally adequate and lawful pretext for the governor to send in the troops. Further, intervening during the commission of a crime is the job of the executive, not the judiciary, and not a civil suit.

Jeb Bush is aware of all this, I'm sure (as is his legal team), but he says he does not have the legal authority to intervene. Randall Terry's own lawyer said Jeb Bush cannot legally intervene at this point.
