It comes down to who gets to determine what his "legal powers" are.
Is it the court system, or the legislature?
According to the court system, Terri must die. Period.
The legislature previously passed legislation giving him the power to intervene and ensure that she lives. They have also passed laws making it criminal to starve a disabled person to death by refusing food in the "natural" manner of eating.
The governor has to make the call on which branch of government he will side with - and it is the judiciary.
