This is the frustrating part for me.
Were this a leftist effort on appeal, the judges would have a tendance to find "spirit" in laws that were never in existence. Conservatives would then say they court is making up law.
Conservatives pass a specific and so the judges say the "spirit" of law is irrelevent and go by the LETTER of procedure.
I have not stated it eloquently but it does seem the courts have now established a two track standard of justice. Once track of analysis if the petitioning party is on the right and a seperate track of analysis if the petitioning party is on the left.
