State officials say they are considering removing Terri Schiavo from hospice, by force if necessary, despite numerous court orders upholding the removal of the artificial nutrition tube that has kept her alive for 15 years.
Lucy Hadl, secretary of the Department of Children and Families, said Wednesday morning that her staff is relying on a state law that gives the department the authority to intervene on behalf of a vulnerable adult who is 'suffering from abuse or neglect that presents a risk of death or serious physical injury.'
Hadl said that the DCF would have to file a petition in order to remove Schiavo, but that 'it doesn't mean we'd have to have judicial approval in advance of taking the action if we believed it met the threshold for doing it.'
Hadl said that seven years of court rulings backing Schiavo's husband Michael, in his contention that Terri Schiavo did not wish to be kept alive artificially would not stop the DCF from taking action.
'We're not compelled to look at prior judicial proceedings,' Hadl said.
What we are compelled to look at is the presenting circumstances and any allegiations of abuse and neglect that we have recieved. So we have to deal with those and fufill out statutory responsibility.'

This is precisely what they are there to do.
For thouands of years kings and dictators had the power of life and death over citizens. That was reduced with the Magna Carta and our founders were in agreement on only one real point. The executive of our states and nation, were not to have any direct power over citizens. Only judges and juries could have such power in our nation.
To believe that Govenrors and Presidents can take custody of individuals is just nuts. The one exception was non aligned combatants in military conflict. It used to be that those who engaged in combat with out being attached to a nations miliary had no rights. That was the basis of our holding the terrorists in cuba. But now that is being overturned by the courts.
No president has ever had the right to take charge of any citizen with out first gaining permission of the courts.
Some may not like the way our goverment works, but that is how it works. Nothing could be more dangerous than giving a President life and death control over citizens. Some president would figure out that all he had to do was kill those that disaggreed with him. That is what kings and dictators did for centuries.
Love it or hate it our personal freedom is in the hands of judges. It is judges that need to have their power curbed. Taking life and death power away from Presidents, kings and governors was the most important act to giving citizens any freedom.
He has no authority to tell executive agencies how to react to new situations that are not before him. He can only rule on facts that are presented to him after they have occurred. This has gone beyond ridiculous to absurd.

A question like that was asked at the news conference.
A DCF official answered that DCF has to respond to a specific complaint -- they don't just go around looking for problems.
I believe DCF received a "hotline" complaint sometime in the last couple of months.
I may be wrong, since I couldn't hear the entire press conference too well (due to that idiot Shep Smith's butting in with BREAKING NEWS); but I heard someone say later that the complaint was made by Mayo Clinic neurologist Dr. William Cheshire (the doctor who has now stated in a sworn affidavit that Terris is NOT in PVS, but is rather "minimally conscious").

no way I would like to be kept like a house plant just to say I'm alive by those that love you.
It won't happen to you by those that know and love you - because they would give you range of motion, therapy, interaction, good medical care, take you out in the sunshine. You end up like this w/no care and she is still very much capable of living a productive life but her 'guardian' says no - not a loved one - just a guardian.
