Letting a lower court decision stand without comment/review is accepting said decision. Sort of like teh president not signing a law but not vetoing it either which after some days turns that bill into a law without his approval - or more accuratly - without his signature.
It's all a moot point now cause it's going before the court so there will be no speculation as to where they stand on this.
