It would not surprise me if this case made it to the Supreme Court. And there they would have to move quickly(for a change). But, I don't have a clue how they would rule.

Nurse,Carla, that took care of Terri on Laura Ingraham. "We found evidence of needle marks on Terri's, concealed insulin needle in the garbage". Michael obviously tired to kill her with the door closed and locked, he tried it five times, this is a law enforcement case, where is law enforcement?

In my opinion, the SCOTUS won't rule at all. They're more likely to simply refuse to hear it, especially if the 11th agrees with the previous federal judge.
They do not have to consider any case whatsoever, except in a few instances laid out in the Constitution. This case does not fit any of those categories, as far as I can tell.
