This is about individual rights and not states' rights. Congress has the constitutional authority to have a federal court review the case. This was a bipartisan effort. The Senate voted unanimously by voice vote for the measure and about half the Democrats (those who were present) voted for it in the house. The federal court may even decide not to take the issue up.

We would still have segregation if states' rights were observed or even a smaller country if states had the right to secede.

Exactly. When the constitutional scheme of limited government is observed we have a more perfect and happier union. I don't put the blame on Congress for checking the excess of an arrogant and accountable judiciary; I blame it on judges who go off into the deep end believing they are the masters of the American people. Its the duty of the elected branch of government to restrain them and to make sure they don't overstep their lawful jurisdiction. Too bad Judge Greer flipped off at Congress by disobeying a lawful federal subpoena. Then the Schiavo law would have been completely unnecessary.

It's pandering. If Congress acted on principle all parents with children like Terri would be empowered.

Hold on now!

It was the Supreme Court who reviewed the case, and Congress did not like the decision. So, COngress decided to pass a new law. That sounds like Democratic Party trickery to me!
