You know,until this all came up I didn't realize that an American did not have access to a federal court. That seems like it ought to have been an automatic given.
They do not have access to a Federal court unless the case is on it's face a Federal issue or there is statutory support for treating it federally, as in Habeas Corpus for deathrow inmates. I know Gibbs tried to bring a case in a FL Federal District court before, and was turned away by a judge named Moody. Same court Whittmore is on I believe. Moody claimed there was no federal jurisdiction in this case that originated in a FL court, namely Greer's, of course.
