You people really should read the constitution. States have powers over and above the feds. The feds have very few powers relating to the internal workings of a state. The state judge has every right to overrule the federal judge and that is the way it should be. You people are trying to break all sorts of laws, constitutional and other wise, to uphold your good intentioned but wrong headed views about Terri. SHE IS BRAIN DEAD. That means she can't recover.
She is not in a coma, coma patients sometimes recover, people who have no cerebral cortex never recover and this is Terri's condition as sad as it may be. She is never going to recover, she is not responsive regardless of what you have convinced yourself of. Let her go, let her find some peace.
When an injustice of this magnitude is being done in the name of the law, the law is wrong and must not be followed.
To allow a person to be killed because they are disabled is immoral. Not being able to recover from a disability does not make it right to kill a person. Terri is most definitely not brain dead. I realize it gives you a great deal of comfort regarding your position to believe otherwise.
So, you've seen the video of the doctor calling to her to open her eyes...and Terri opens them?
You've seen the happy look she gets when her mother comes in the room. I guess that is brain dead, huh?
EVERYONE WHO HAS WORKED WITH THESE TYPES OF PATIENTS AND HAS SEEN THE VIDEO KNOWS SHE HAS COGNITIVE FUNCTION AND IS NOT PVS.
They say (and the video shows) that Terri is swallowing her own saliva. The judge and Michael will not permit her to be fed orally. If I stretch it, I "might" be able to understand the leaglity of removing the feeding tube as a medical proceedure. There is NO WAY that any human can condone them not permitting her food orally.
The woman is brain damaged. There are a lot of brain damaged people out there that are still be fed.
She is not BRAIN DEAD. A brain dead person, cannot breathe on his own, can not open their eyes, cannot have any reflexes, cannot maintain their body temperature, etc. She is sitting in a chair, eyes wide open, making sounds, etc. If that is your criteria for brain dead, most people in nursing homes and in their own homes would be up for grabs. So would infants, and toddlers. If you don't believe me look at the Harvard Criteria of brain death.
If I were brain dead, the machines would be off already here in Germany, or they would be kept on to take some organs from me the docs have use for (don´t worry, I have filled out a declaration that I want to donate organs).

Except that's not the way it has been going. The FEDs have excerpted state powers all over the place. I can imagine the pandemonium on the left if this decision effected 1 of their pet ideas.

There is no such thing as an "other wise" law. If a law isn't constitutional, by definition it isn't a law.
That being said, if where you live they do have "other wise" laws, well... it must be a real hoot to live there.
And as to reading the Constitution, try it - it's fairly short and won't hurt you. Oh and FYI, nowhere in it does it mention "other wise" laws.
Are you taking the "Tommy" position? You know - deaf, dumb, and blind - in this case? The DOCUMENTED reactions and interaction by Terry with her environment and visitors is proof that she is not brain dead. Brain death allows no interaction. Brain death gives no reaction. Brain death results in no awareness. Terry is not only able to react, she can communicate and interact with those around her. She recognizes voices, she smiles, she moves, she does a lot of things that someone who is "brain dead" are not capable of.
Again, I suggest you do some reading, including right here on this thread, before you pass judgment. Otherwise, you are just as guilty as this judge.

Nevertheless, I thought this may happen last night. I did not think this radical judge would obey Congress unless a federal judge ordered him to do so.
State judges do NOT have the power to trump federal judges. Federal judges are of higher rank (for lack of a better term) than local or state judges, thus the term higher court. If you were half the constitutional expert you claim to be, you'd know that.
Some men were arrested this morning for tresspassing after trying to sneak food and water in to Terri.
I left yesterday thinking Terri was safe for another week. I cannot believe this crap.
You know you say she is brain dead and frankly if she were at least she couldn't feel the pain of the horrible death they are trying to impose on her.
it really makes me mad that brain dead is equated to diminished capacity. This woman knows her family recgonized them and reacts. She will feel the pain and it will go on for day while she staves to death. It is one of the most painful deaths one can sucuum to.
So get your facts right before you scream she's brain dead because that makes you no better than the brain dead judge.
