Here's what wrong with Wexler's "19 judges" argument:
1 - As we learned in 2000, the Florida state courts are quite bad.
2 - After the killer-judge Greer found the facts that Terri was in a persistent vegitative state and said earlier she wanted to die if incapacitated, the subsequent Florida state judges reviewed those findings using a deferential standard, leaving those facts in place even if wrong. Deferential review frequently leaves wrong facts undisturbed.
But under the bill to be passed at 12:01, a De Novo review by a federal court, after a full new trail, may find quite different facts.
