Well they have to get all the evidence in front of the Federal judge to be considered.. EVERYTHING.
It is my understanding that everything in the case would be up for Federal review. However, the FOCUS of the review is whether or not Terri's Civil Rights as an American, and perhaps as a disabled person but I don't know that, under the Constitution, have been violated in the handling of her case.
