Bump. Since this is already national and global our leaders just can't stand idly by and let harm come to Terri for a 3rd time. It is illegal to starve animals for gosh sake! Thanks for your calls.. keep em coming!!!

I called Gov. Bush, and my husband called Gov. Bush.

Also, I e-mailed Gov. Bush and am praying for Terri and all concerned.

In the past I wrote a letter to the editor to both secular and Catholic newspapers, which were published.

I wish I could do more.

Anything else that I can do?

I'm not going anywhere. I will not fall prey to the divide and conquer tactics of the pro-death crowd...but I will question FreeRepublic if I think they are caving in where Terri is concerned.

Florida Statute 415.1051 (Adult Protective Services)
Protective services interventions when capacity to consent is lacking


(2) EMERGENCY PROTECTIVE SERVICES INTERVENTION.--If the department has reasonable cause to believe that a vulnerable adult is suffering from abuse or neglect that presents a risk of death or serious physical injury to the vulnerable adult and that the vulnerable adult lacks the capacity to consent to emergency protective services, the department may take action under this subsection. If the vulnerable adult has the capacity to consent and refuses consent to emergency protective services, emergency protective services may not be provided.

Florida Statute 825.102
Abuse, Neglect and Exploitation of Elderly Persons and Disabled Adults

"Abuse of an elderly person or disabled adult" means:
(1a) Intentional infliction of physical or psychological injury upon an elderly person or disabled adult;
(1b) An intentional act that could reasonably be expected to result in physical or psychological injury to an elderly person or disabled adult; or
(1c) Active encouragement of any person to commit an act that results or could reasonably be expected to result in physical or psychological injury to an elderly person or disabled adult.
(2c) Knowingly or willfully abuses an elderly person or disabled adult and in so doing causes great bodily harm, permanent disability, or permanent disfigurement to the elderly person or disabled adult.

Welp, like any political presence, he has legal advisors. That may be the sticking point.

And since I'm not a lawyer and don't play one on TV, I'm just giving you a simpleton's interpretation of those laws. 415.1051 enables Adult Protective Services through the Department of Children and Families to provide protective custody for an incapacitated person who is the victim of alleged abuse. The Governor is the chief of that department.

825.102 outlines what constitutes abuse and, since it's the law, I can't see how a judge can override it.

Put like this - I rob a liquor store. The state has me arrested and charged. I tell the state "well, the judge said I could do it." Would that hold even a drop of water?

The state has and always had the power to act.
