Andrew Hoffer is my fiance, there's one thread about his story already from the NY Post that someone put up. I wanted to put this CBS2 one up myself since it has a clickable link on the page to the video that aired on t.v. He's willing to type on here and answer any questions pertaining to the letter or whatever else. The public should know what's really going on, it's not about just the tax, that's not even the big issue. Please post comments of what you think about this story and questions are welcomed. Andy told me already he will come on here if anyone would want that. Thank you all for reading this. ~ concerned fiance of Andrew

These small desparate measures by New York State are laughable (except to the few chumps who got nailed).

Most of the poor demented addict smokers I know do not pay one penny in New York cigarette taxes. They go to Indian reservations, Internet, and the growing number of bootleggers.

Here are some interesting excerpts from emails that I received from an online cigarette company:

"Last Monday evening *********** suffered a banking attack, which was propagated by the State of New York. Appears New York does not like internet cigarettes sales, and is doing everything possible to keep people from shopping where they wish."

"MasterCard, whose home office is in New York, has succumbed to pressure form New York's Attorney General. They have decided their card holders can no longer utilize their MasterCards for the purchase on internet cigarettes. MasterCard was told by New York that the purchase of internet cigarettes constitutes Mail Fraud, Wire Fraud, violated the Contraband Cigarette Trafficking Act, and the Jenkins Act."

"Needless to say our processing bank, Merrick Bank of Utah freaked, and turned us off with out even the decency of a heads up. We discovered it Monday evening when we were trying to process a phone order."

and, last but not least:

"It appears UPS has requested we no longer utilize them to ship to the following states; Alaska, Arizona, Connecticut, Illinois, Maine, Michigan and New York."

I'm speechless.

Did he allow the cigs to be delivered US mail or did they use FedEx and UPS?

Why didn't this website lose the database or keep it off site so there would be no problems?

The city, state and feds probably do have the legal right to get the taxes, but I don't know why the website had to keep such good records of sales and identifications.

If they were on indian land, how does anyone get to the business and serve a search warrant without some kind of notice?
