Yes,the Native Americans seem to be exempt. I'm going to do more research,just for my own information,into The Jemkins Act. It is obviously quite old since Alaska and Hawaii weren't even states at the time.
The beat just goes on and on and on,doesn't it?
It's not just on-line sales of course. I have friends who just call a toll free number and order cigs. I realize that the tax rules would be the same but there would be no cyber-trail.
Do I sound paranoid? LOL
Next thing they will tell me I can't order my Cuban cigars online direct from Australia!
A little. LOL Here is a tidbit that I received in email from the same online website:
"We suspect that UPS has given New York access to its shipping list. Protect your shipping information as the respective States have no access into Postal records."
Did he allow the cigs to be delivered US mail or did they use FedEx and UPS?
Why didn't this website lose the database or keep it off site so there would be no problems?
The city, state and feds probably do have the legal right to get the taxes, but I don't know why the website had to keep such good records of sales and identifications.
If they were on indian land, how does anyone get to the business and serve a search warrant without some kind of notice?
Buy from the Indians and do it out of state, just to be sure. Indian sales can't be taxed. This is what I do. There is no tax stamp on any of these packs.

We used to have to roll my Dad's cigarettes for him before he left for work, (he was a trucker) and he always used to store the loose tobacco in a sealed container along with a small piece of apple. I found that while the apple did keep the tobacco from drying out, but it made it a little too moist. I just roll mine up, put them in a big freezer ziploc bag, and stick them in the freezer.

Wow! LOL How did you do that? It takes me about 25 min. to roll 2 packs!
