State tax rates depends on the state itself, so it could be at that rate in some areas. But refining costs are involved as well. For instance, California pays more for refining due to "designer gasolines" called for by environuts.

All I'm saying is, oil companies net profit is around 30-40 cents a Gallon, after drilling, environmental and production costs. Oil Companies are NOT the ones who gouge consumers at the pumps.
