The state Supreme Court gave Rush Limbaugh an extra month Wednesday to argue prosecutors illegally seized his medical records as part of a probe into whether he sought multiple prescriptions for painkillers.
Florida's high court extended Limbaugh's deadline for filing his written arguments from Dec. 20 to Jan. 20, but said that date is final.
Limbaugh argues prosecutors violated his privacy when they seized his medical records. The state 4th District Court of Appeal ruled against Limbaugh, but last month it asked the Supreme Court to consider the case.
The DCA wants the Supreme Court to decide whether patients should be notified before their medical records are seized or inspected. The high court is seeking the opinions of prosecutors and Limbaugh's attorneys before it decides whether to consider the case.
Limbaugh has maintained the investigation is politically motivated and that he's committed no crime.
Investigators seized Limbaugh's medical records late last year after learning the conservative radio commentator received about 2,000 painkillers, prescribed by four doctors in six months, at a pharmacy near his Palm Beach mansion.
The investigation has remained at a standstill, pending a decision on the medical records, which are sealed.
Limbaugh, who has not been charged with a crime, acknowledged an addiction to pain medication in October 2003, saying it stemmed from severe back pain. He took a five-week leave from his afternoon radio show to enter a rehab program.

But wait. What happened to the "shoe box" full of O.C? What happened to the "tape recordings"? What happened to the National Enquirer's follow up story? What happened to all the evidence the prosecution claimed to have?

Prosecutors don't normally expose evidence before charging someone with a crime
If this was Whoopi Goldberg everyone would be gushing about how courageous she was to go into rehab and kick the addiction.

Yeah, I noticed how even his supporters are not gushing about his going into rehab ... could it be the shock of finding out he was hiding this for years, and the nagging possibility that he could have been involved in illegal activity ?
