Kerry IS (an) a hole.
This is exactly what he wouldn't dare do during the campaign itself for fear of what O'Neill could bring to the table in evidence and eyewitnesses and furthermore, what he might be able to subpoena. If Kerry wants to risk whats left of his reputation in a bitter bid for vengeance, that's up to him.

If Kerry sues, he'll rue it. The suit will be tossed on a pre-trial motion of some sort, depending on the jurisdiction. He may be liable for malicious prosecution, compounding his problem.
