I think that the Marine is still in hot water, and this is why. For one, the political pressure from the media and other governments will be very heavy to see this guy punished. Also, the appearance of wrongdoing may prompt the military to make an example out of him anyway, simply to ensure discipline. Right or wrong, they've laid down a policy, and now they'll either enforce it or they won't.

It would be a hard sell for the military to say, 'He violated the ROE, and if anyone else does they'll be punished, but we'll let this Marine slide because his violation became a media event'.

It would be an easier (and more honest) sell to say, 'The ROE isn't based on common sense for the situation, and it puts troops in unnecessary danger, so we're changing it', but I doubt they'll sack up and do it.
