If the prisoner fakes being dead, then he has not submitted himself as a prisoner of war--he could be biding his time to strike out at the marines. As such, I suppose he could be considered an active enemy combatant.

I suppose the question becomes whether the insurgent in question was actually seriously wounded to the point that he could not speak up and identify himself as being alive (which would get him medical care from the marines) or whether he was in fact "faking" in order to carry out an attack on the unsuspecting marines.
