Well the evidence is all circumstantial...and a man should not get the death penality when there is NOT conclusive proof. One hair doesn't do it...

Oh, anybody can appeal.

But winning is a different story. Even if it's error, the appellate court can still find harmless error.

I can't speak to the niceties of California law. But unauthorized experiments with trial exhibits don't necessarily mandate reversal in my home state.
