They don't have to send him to death row if they convict him of 1st degree. But if some jurors don't think pre-meditation was proven, it gives them a way to convict him anyways. I'm so glad Calif law precludes the defense from using an "all or nothing" jury charge as trial strategy. In this case, it would be a dumb move anyways. I think it would only guarantee a 1st degree conviction-I don't see the jury letting him off.

I heard they were going to allow a 2nd degree as well. He would get TWO counts tho. Two people died at his hands.
There is talk that the Judge is thinking about telling the Jury that they may consider 2nd degree murder when they get the case for deliberation. May be easier for some to convict if they don't have to send him to Death row.
And I read that in CA, the Defense cannot protest the Judge if that's his decision.
