It makes for a vacancy on the court - same as if he resigns... one opening for a assoc. justice; and another opening amongst the 8 for Chief Justice. But Kerry will now be running amok (again) yelling about "a vote for Bush puts Scalia in charge of the Supreme Court."

If he were to pass, the Dems would demand no new Justice be nominated until after the election and swearing in. Then, whoever Bush put forth would be feasted upon by every liberal west if the Atlantic until a "proper" nominee was put forward.
