Just imagine the following people on the Supreme Court appointed by President Kerry. Laurence Tribe and Alan Dershowitz of Harvard. Or how about Patrick Leahy? Maybe Justice Richard Durbin or Justice Rose Bird or Justice Hillary Rodham Clinton (who is an attorney and it would be one way to get her out of the way--she still has her licence to practice law even though bill was disbarred in Arkansas.

He had this surgery while the court is not in session and is expected to be back next week.

Rehnquist Hospitalized With Cancer in Md.

Oct 25, 12:13 PM (ET) http://apnews.myway.com/article/20041025/D85UICHG0.html

WASHINGTON (AP) - William H. Rehnquist, second oldest man ever to be chief justice of the Supreme Court bench, has been hospitalized with thyroid cancer. … Rehnquist is expected back on the bench when the court returns to work next Monday.

... Rehnquist spent the weekend in Bethesda Naval Hospital in suburban Maryland, and underwent a tracheotomy on Saturday, the Supreme Court said Monday in a statement.

The Supreme Court is not meeting this week … Rehnquist, named to the court in 1972 by President Richard Nixon and elevated to chief justice by President Ronald Reagan in 1986, has had a series of health problems.

In 2002 he missed several court sessions after hurting his knee in a fall at his home. He had surgery to repair a torn tendon. Rehnquist also has struggled with chronic back pain over the years. Rehnquist turned 80 earlier this month, a milestone reached by only one other chief justice of the United States. The only older chief justice was Roger Taney, who presided over the high court in the mid-1800s until his death at 87.

Yeah, socialist leftists seeing hammer and sickle dreams with the Rehnquist's news.
Hope the judge pulls through with no problems and laughs at them all. *prayers*

If the Demonrats can manage to abolish the electoral college, Demonrat vote fraud operators will turn the entire nation into one giant Florida 2000. Chicago, Chicago, Chicago and every two-bit Demonratic urban machine will be stealing votes, voting cemeteries, registering fictional voters and motor votering their way to "victories" by popular vote.

or Justice Rose Bird

Especially appropriate Demoncrat move, since she's been dead for years.

Don't recall -- but yes, a President could nominate anybody for chief justice. More typically, I believe it would be a current court member. How 'bout Robert Bork? :D

My husband survived thyroid cancer but years later died of lung cancer.

My prayers for Justice Rehnquist and for his family. Keep the faith!

Oh my good Lord, I just realized John Kerry will try to capitalize politically on Judge Rehnquist's pain.

I find it surprising that he will be going back to work so soon after a fresh tracheotomy.

This will stimulate the mad dog Democrats to action more than the Republicans. Democrats appreciate how crucial the Supreme Court is. Isn't the Grim Reaper due for Ruth Ginsberg?

If this isn't motivation to get out and vote for Bush I don't know what is.

Don't forget conservative Senators.

Force the real thing or put it to a vote.

How do you "force" the real (filibuster) thing?
