Kerry received an HD because the Navy never prosecuted him for the "crime," i.e., meeting with the enemy in time of war. Yanking his security clearance would not prevent him from getting an HD. Senators still need a security clearance. If I recall, Leahy was kicked off of the intelligence committee for leaking information.

But they only way I see of clearing up these questions is for Kerry to sign the 180 form

That is not necessarily true. The military allows for nonjudicial punishment i.e. Article 15 (Army/AF) or Captain's Mast (or something like that) in the Navy/USMC. There are also other nonjudicial procedures know as "Chapters" that can result in an "Other than Honorable" Discharge without going through a court martial. I am sure a military lawyer out there would have better info on this subject than I.

Senators still need a security clearance [to sit on the Intelligence Committee]. If I recall, Leahy was kicked off... for leaking information. Perhaps no-one ever checked Kerry's security clearance level.
